Misuse of tax payers' money for private congratulatory newspaper advertisements.

Request to Chief Justice Sindh High Court for suo moto notice

Your Honor,

This is an appeal to you for taking suo moto notice against Dr. Syed Mohammad Ali

Shah, Special Assistant to CM on Sports, Government of Sindh, who misusing the

government funds placed a quarter page advertisement to congratulate the Sindh

Governor for completing ten years of his tenure as the Governor. The advertisement

appeared on January 30, 2013 in the Dawn newspaper and a copy of the same is

attached with this application.

The advertisement relates to a personal matter, in which the special Assistant to the

CM wishes to congratulate the Governor for something that he personally perceives

to be of interest or importance. However this personal advertisement is placed using

government of Sindh funds or in other words at the tax payers' expense – as evident

from the Government of Sindh insignia at the bottom left of the advertisement.

While fully realizing that there is no law against low order and obsequious style of

appeasement, my application relates to an entirely different subject. The government

funds are a trust that must be exercised by officials only for the good of the people

and in a lawful manner. Your honor, this advertisement is a gross abuse of

government

funds as it relates to an entirely private communication – an individual trying to

appease his superior and also marketing his own image.

PRAYER:

It is, therefore, most respectfully prayed that this Honourable Court may graciously

pass judgment and orders in the following terms:

1.

Direct Dr. Syed Mohammad Ali Shah Special Assistant to CM on Sports,

Government of Sindh to refund from his personal pocket the entire amount spent on

the congratulatory advertisement placed for his benefactor, the Governor of Sindh

in the Dawn newspaper of January 30, 2013.

2.

If the same or similar advertisement was placed in other newspapers, the full

amount spent on those be also returned to the state exchequer.

3.

Direct Dr. Syed Mohamamd Ali Shah Special Assistant to CM on Sports,

Government of Sindh to issue a press release stating his unqualified regret and

apology for misuse of public funds and some words to the effect that he would not

repeat such an unlawful act in future.

4.

Any other judgment and orders that the court may deem fit.
